Great American Antique Mall Dealer / Vendor Agreement

Monthly Booth Pricing for a 10x10 is $350.00 inclusive of taxes and fees

$3.50 per square foot for larger and smaller booths inclusive of taxes and fees

Monthly Showcase Pricing

Lighted & Locked
6 X 4 (5 shelves) $135 inclusive of all taxes and fees.
5.5 x 18 inches (2 shelves) at checkout counter $135 inclusive of all taxes and fees.

Showcases are available by the case only, no consignment items are allowed in the showcases except for items above $500, from one owner with fewer than 5 items in the entire mall.

Consignment
60/40split between the vendor and GAAM. The consignor receiving 60% and the GAAM receiving the 40%. The GAAM will remit balance due by the
10th of the following month of sales made during the previous month.

Consignors will be accepted as space permits.

Consignor may deliver and arrange consigned items in the designated consignment space. The GAAM reserves the right to arrange and display consigned items in an attractive manner. Consignor's items may be displayed with another consignor’s items to make good use of space and allow for as many items as possible to be displayed. All arrangements will be made in good taste to encourage sales. The GAAM wants everyone to be successful! The GAAM may decorate larger pieces of furniture with
smaller items (flower vase on a table, books on a book case, etc. It will be done all in good taste.)

All lightbulbs must be LED. No incandescent bulbs are permitted.

1. The equivalent of one month’s dealer fees is required as a deposit on all showcases/booths.

2. A 3 month lease will automatically renew for each additional subsequent month unless 30 day written notification is provided by the dealer.

3. 30 day written notification must be given in order to be eligible for returning of security deposit.

4. Vendor must provide the GAAM with bank account information for direct deposits. By the 10th of the month, the GAAM will deposit profits from merchandise sold (less dealer fees and fees) into the dealer’s bank account from the previous month. GAAM will provide a monthly statement of activity for each dealer. Dealers and consignors will be able to enjoy the dealer portal allowing real time updates of sold merchandise.

5. Booth/showcase must be cleaned and left in the same condition in which is was on day one of lease for security deposit to be returned.

6. If the sales of a vendor do not cover the dealer fees for 3 consecutive months, GAAM reserves the right to not renew the vendor’s contract.

7. There is a 10% commission for all merchandise sold by dealers. This amount will be deducted from the monthly dealer payment.

8. Dealer fees are due on the first day of the month for that month.

9. Dealer fees will be deducted from accumulated sales of the previous month. If dealer fees exceed sales then payment by the vendor is due by the 21th of the month. If dealer fees are overdue by 30 days, unsold merchandise will be sold by GAAM to cover past due dealer fees and cannot be otherwise removed from the mall until dealer fees are paid in full. Dealer fees extends from the first day of the month to the last day of the month. Vendors will be notified via email of fees due.

10. GAAM will be responsible for the collections and payment to the Treasurer, State of FL. Dealers may not use GAAM’s sales tax exempt number for their own personal use.

11. The close of business on the last day of the month is the cut off date for processing sales. One month’s dealer fees and all commissions will be deducted from the sales. A statement of the month’s sales activity will be provided to each dealer via email.

12. Dealers are responsible for furnishing their own tags. Items placed in a booth must have a price tag with the following readable notations on the front: Vendor Number, Item Description, Price. Dealers are solely responsible for securely fastening all tags.

13. GAAM will not automatically give a buyer 10% off unless the buyer requests it. 10% off is eligible for items over $30.00 and only by request. Items not eligible for a 10% discount must be marked “FIRM”.

14. Dealers are responsible for keeping their booth/showcase clean & dusted. Walkways must remain clear of obstruction.

15. The management of the GAAM reserves the right to prohibit any item from being sold on the premises. All sales will go through the computer/cash register at the GAAM, Inc. Any sale that does not go through the register will violate this agreement and serves as a cause to terminate it. Vendors working in their booths may negotiate a special deal or a reduced price to a customer but are not allowed to complete the sale on premises without going through the GAAM register.

16. The GAAM does not permit the sale of pornography, drug paraphernalia or animals.
Management reserves the right to refuse any merchandise we feel is inappropriate.

17. Smoking is not permitted on the premises or within 25 feet of the doorway where
smoke can drift in.

18. All sales merchandise must be kept within each vendor’s assigned space.

19. Vendors shall at all times abide by codes, ordinances and city, county, state and
other governmental agencies having jurisdiction over the conduct of the vendor’s
business.

20. Move-outs shall occur on or before the last day of the month. Holdovers will be charged an additional month’s Dealer fees. Management must be given a written 30 day advanced notice of a move-out BY THE FIRST DAY OF THE MONTH. dealer must settle all overdue dealer fees charges and damages before removing merchandise from the GAAM on move-out day.

21. GAAM accepts cash, credit and debit cards. GAAM will not accept checks.

22. Vendor is responsible for his/her own insurance. GAAM Inc. will not be responsible for any loss or damage of merchandise, property or equipment, either from natural or unnatural causes such as theft, fire, flood, wind, rain, or any other causes whatsoever.

23. No electrical items with cloth or frayed cords may be plugged in at any time. Testing of said items is allowed at the front register’s outlet.

24. Vendors are required to maintain a high quality of merchandise in their booth. The management of GAAM reserves the right to terminate a lease if items brought in to sell are consistently not of the quality represented in pictures or written description on the vendor’s application. The GAAM will continually strive to maintain a high quality customer base and vendor merchandise.

Layaways require 50% down and the balance due in 30 days. There are NO REFUNDS on layaway payments. If the transaction is not fulfilled, the customer loses the downpayment. Layaway merchandise may stay in its original location or moved out of the dealer’s booth with a SOLD attached.

While the GAAM takes takes security measures, the GAAM is not responsible for theft and will not replace, refund or restore items stolen or damaged.
I have read, fully understand and agree to the above terms and guidelines set forth by the GAAM and will abide by them.

I, _________________________, hereby release the Great American Antique Mall, its employees and management company from any liability, accident, theft, damage, injury or concern that occurs while I, an assistant, acquaintance, employee or friend helping arrange my booth, are on the premises of the GAAM. I contract space and assume all liability and responsibility for my booth, showcase, property, safety, well being and health while on the premises of the GAAM and do hereby release GAAM from any responsibility, compensation or recompense.
